Appealing a Probation Decision

A probation appeal asks a different decision-maker to review an extension, failure or dismissal outcome where the policy allows it. Appeal deadlines can be short, so secure the decision, policy and evidence immediately.

What can usually be appealed

The policy may permit appeals against probation failure, dismissal or an extension. It may limit the grounds or require specific information. Read the exact appeal section rather than assuming the appeal is a complete rehearing.

Common appeal grounds

  • The evidence did not support the finding.
  • Important evidence was ignored.
  • The process or policy was not followed.
  • The standards were unclear or changed.
  • Support or adjustments were not provided.
  • The outcome was unreasonable or disproportionate.

The deadline comes first

Record the date the decision was received and calculate the deadline using the policy. If documents are missing, submit a protective appeal within time and explain that fuller grounds will follow if the policy permits.
