When can you appeal?
Formal performance outcomes will usually explain whether an appeal is available and how to submit it. The exact right, scope and process depend on the department policy and the outcome issued. Read the appeal section and the outcome letter together.
Possible grounds can include evidence that does not support the decision, important evidence being ignored, an unfair process, unclear targets, missing support, a decision maker without the required independence, ignored adjustments, new evidence or a warning that is disproportionate to what was proven.
Appeal timescales
Check the deadline immediately and record the date, time and submission route. If you need documents or advice, preserve the deadline with a focused appeal or ask whether further detail can follow under the policy. Do not rely on an informal conversation to extend the time.
- The date the outcome was received.
- The number of working or calendar days allowed.
- The person or mailbox that must receive the appeal.
- Whether the appeal must state full grounds immediately.
- Whether new evidence is allowed and when it must be submitted.
- Who will hear the appeal and what powers they have.
- Whether the original outcome remains active during the appeal.
A focused appeal is stronger
Do not appeal every sentence because the outcome feels unfair. Select the grounds that can change the decision and show the evidence, policy failure or reasoning error clearly.
