Appealing a Sickness Absence or Capability Decision

An appeal should identify why the decision was wrong, unfair or premature and what outcome should replace it. Check the department policy immediately because appeal grounds, format and deadlines vary.

Decisions that may have an appeal route

Depending on policy, you may be able to appeal an attendance warning, formal capability outcome, redeployment decision linked to the process or dismissal. Ill-health retirement medical decisions use a separate pension review or appeal route.

Start with the decision letter

List each finding, the evidence relied on, the reason given, the outcome and the appeal instructions. Your appeal should answer the decision rather than repeat every earlier email.
