Can performance management lead to dismissal?

Yes. A performance or capability process can progress through formal improvement and warning stages to a point where dismissal is considered. The exact route, decision-maker authority, notice arrangements and alternative outcomes depend on the department policy.

Dismissal should be treated as a formal decision stage. The department should define the concerns, evidence, previous improvement opportunity, current policy stage and possible outcome. You should have a fair chance to understand the case and respond.

Before dismissal is considered

The department will usually rely on the history of concerns, targets, support, review outcomes and warnings. Your task is to test whether the improvement opportunity was real, the standards were clear, progress was measured fairly and the evidence supports the conclusion that the required standard remains unmet.

  • Were the correct performance or capability stages followed?
  • Were targets clear, measurable and reasonably within your control?
  • Was the review period long enough and properly recorded?
  • Was promised training, coaching or support delivered?
  • Were health, Occupational Health and adjustments considered?
  • Did management consider your evidence and explain why it was rejected?
  • Were earlier warnings valid and still active under the policy?
  • Is the person making the decision authorised and sufficiently independent?
  • Does the policy require alternatives to dismissal to be considered?
