Resigning During a Disciplinary or Performance Process

You can resign during a disciplinary, capability or performance process. Resignation may end your employment, but it does not necessarily stop the department completing records, deciding an outcome or responding to future reference requests under its policy.

Do not assume resignation closes the case

Ask whether meetings, investigations or decisions will continue during notice. Departments may need to conclude serious matters or record the position reached.

The effect depends on the process, policy, allegations, timing and leaving date.

Separate the resignation from your response

A short resignation letter gives notice. Your evidence, rebuttal, grievance or appeal should normally remain in its own document so each has a clear purpose.

Do not use resignation wording that accepts allegations unless you intend to do so.

Check the wider consequences

  • Notice and pay.
  • Reference wording and employment record.
  • Whether a hearing or review will continue.
  • Whether you need to preserve an appeal or grievance.
  • Pension and benefits.
  • Effect on a new Civil Service role or vetting.

Civil Service departments use different contracts, policies and approval routes. Check your own contract, intranet guidance, scheme documents and any letter you have received before acting.
